General
The ‘Client’ is the natural or legal person who commissions translation or correction work from Mondovortoj. Mondovortoj translator could be any person who fulfil the basic requeriments defined in this site and registered through it.

Article 1
Since Mondovortoj is an open project no Mondovortoj translator is really bounded by a commercial confidentiality or corporate nondisclosure agreement. Mondovortoj Translations takes confidentiality and security issues very seriously and most translations remain confidential but we can not take any commercial or nondisclosure agreement with the Client.

Article 2
Certified translations are governed by local laws in each country. In a non-certified translation the translator is sometimes entitled to give a personal style and tone to the text, to make it more appropriate for the target audience. Certified translations often must be an exact translation of the source and must always include a clause from the certifier together with a round seal affixed which only Certified Court translators may use, and must be certified by the translators signature, in order to be accepted by the courts and the authorities. We are not a Certified translator for any authority, company, government or country around the world. We do not make Certified or Official translations. Even if Mondovortoj translates any legal document it will not have any legal value.

Descriptions, such as "official translation", "Certifying the correctness of the translation", "Certifying word-by-word compliance of the translation", or similar phrases are not officially recognized certification clauses according to applicable laws. Actions for injunctions may be brought against persons producing such translations.

Article 3
Acceptance by Mondovortoj of a commission for translation or correction work is conditional upon Mondovortoj first having seen the text for translation or correction. In addition, Mondovortoj shall have the right to cancel a commission it has already accepted without being liable to pay any damages, provided the commission is cancelled within a reasonable period of time.

Article 4
Mondovortoj shall ensure that the quality of the translation it provides complies with the standards by which experienced translators generally assess texts submitted for translation. Mondovortoj will only take account of further instructions from the Client with regard to the translation content insofar as these are consistent with the quality requirements set out in the previous sentence.

Article 5
The liability of Mondovortoj with regard to damage/losses suffered by the Client as the result of late delivery, errors, omissions, incorrect terminology or other errors in a corrected test or translation supplied by Mondovortoj shall be restricted to the demonstrable direct damage/loss suffered by the Client, on condition that this does not exceed the sum of the agreed fee and other costs agreed for the translation or correction work.
Mondovortoj shall not be liable for mistakes, omissions, incorrect terminology or other errors that are the result of ambiguity or a lack of clarity in the text provided by the Client for translation or correction.

Article 6
The Client has the right unilaterally to cancel a commission for a translation or correction, on condition that he informs Mondovortoj in writing. If, on receipt of a written notice of cancellation from the Client, Mondovortoj has not yet instructed a translator or corrector to undertake the work, the Client shall be liable to pay the costs incurred up to the time of cancellation. If a translator or corrector appointed by Mondovortoj has already commenced the work, the Client shall be liable to pay the fee and costs agreed for the work, plus compensation equal to 30% of that agreed amount.

Article 7
If the Client has a complaint with regard to a translation or correction commissioned from Mondovortoj, the Client must notify Mondovortoj within eight working days (the first day being the day after the translation or correction has been sent to the Client). Parties shall then consult with each other in order to find a satisfactory solution, in accordance with the quality of the translation as described in the first sentence of Article 2.

Article 8
Unless explicitly stated otherwise, Mondovortoj shall retain the copyright of translations.

Article 9
1. The Client may make alterations to the translation or correction provided by Mondovortoj, provided that these are only minor changes that do not deviate from the standards against which experienced translators generally assess the translations they deliver.
Mondovortoj accepts no responsibility for alterations made by the Client to a translation or corrected text, except in the event that Mondovortoj has agreed to the changes in advance and in writing.

2. If the changes made by the Client to a translation or corrected text are such that they damage the good name of Mondovortoj, or if Mondovortoj suffers any other form of damage or losses, the Client shall be liable to pay a penalty equal to 20% of the fee and costs agreed for the commission, notwithstanding the rights of Mondovortoj to claim compensation for actual damage/losses suffered or to be suffered in the future. The minimum penalty shall be € 250.

Article 10
Mondovortoj shall not be liable for damage resulting from the loss, destruction or damage of manuscripts, documents, papers or books entrusted to it, except in the event of gross negligence.
The risk of sending the items described in the previous sentence shall be borne by the Client.

Article 11
The right to claim compensation within the meaning of Article 3 shall lapse one year after the translation or corrected text has been delivered, or one year after Mondovortoj has received written notice from the Client that he wishes unilaterally to cancel the commission.
